2. HOW TO ENTER: To participate in the “Tires Plus Next Big Thing Scavenger Hunt” contest, visit any bay area Tires Plus location and pick up the official list of NBT Scavenger Hunt photos and the Tires Plus/NBT Sign.  Take as many of the photos of yourself and the Tires Plus/NBT sign in the situations described on the list.  Photos should be uploaded to Instagram with the hashtag #tiresplushunt for entry.  In addition, the photos can also be submitted on a CD-ROM and dropped off or mailed to “97X/Tires Plus NBT Scavenger Hunt Entry, C/O WSUN, 11300 4^th Street N., Suite 300, St. Petersburg, FL 33716.  Once photos are uploaded to Instagram, or mailed, entrant must register their name, instagram ID, phone number and email address at the “Tires Plus NBT Scavenger Hunt” contest page found at 97xonline.com.  All entries must be received by 5pm, November 29, 2013.  The entry that has the most pictures completed will be awarded the Grand Prize.  In the event of a tie, a random drawing from the entries with the most completed photos will be held.  In order to participate and win you must be at least 18 years of age.  No laws may be broken in order to obtain the photos.

3. ELIGIBILITY: The “Tires Plus Next Big Thing Scavenger Hunt” contest is open only to Florida residents.   Employees of Cox Enterprises, Inc., Cox Media Group, Inc., WSUN-FM, other radio stations, Tires Plus, promotional sponsors, and all affiliated companies (and the immediate family members of all such employees, and all other with whom they are domiciled) are not eligible to participate in the contest or win prizes. The term, immediate families include spouses, grandparents, siblings, children, and grandchildren.

Each entry photo must be a new and original work created solely by the entrant during the contest period.  By entering the contest, entrant acknowledges, represents and warrants that: (i) entrant is the sole author and owner of the copyrights and other right, title and interest in each photo and any other entry posted on entrant’s instagram feed (collectively, a “submission”); (ii) the submission does not violate or infringe the copyrights, trademarks or other intellectual property or proprietary rights, moral rights, rights of privacy or rights of publicity of any person (living or deceased) or entity; and (iii) no other party has any right, title, claim or interest in the submission.

Submissions may not contain, as determined by Sponsor, in its sole discretion, any content or materials that; (i) are obscene, dangerous, vulgar, indecent, disrespectful, defamatory, slanderous, libelous, disparaging, tortuous, pornographic, sexually explicit or suggestive, violent, lewd, offensive or otherwise objectionable or inappropriate; (ii) promote bigotry, racism, hatred or harm against any group or individual or promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state, or local law, ordinance, or regulation; (iii) include information by which any person(s) other than entrant may be personally identified, such as names, license plate numbers, e-mail addresses and street addresses; (iv) relate to lotteries or gambling; (v) link to or promote a webpage or otherwise make available any unsolicited advertising, “commercial pitch”, promotional materials, junk mail, spam, pyramid scheme, or any other form of solicitation; (vi) violate or infringe the intellectual property, privacy, publicity, moral or other appropriate rights of any third party; or (vii) are otherwise unlawful, in violation of, contrary to, or not in compliance with , the laws or regulations in any country, state or province where the submission is created, these Official Rules and/or Instagram’s respective terms and conditions of use/service (as applicable).  Any submission that does not comply with the foregoing, in the sole discretion of the sponsor, will be disqualified and eliminated from consideration.

By entering this contest, all entrants grant to the Sponsors, the non-exclusive, irrevocable, perpetual, worldwide, royalty-free license to use, reuse, publish, reproduce, transmit, distribute, display, exhibit, edit, enhance, alter, adapt, modify, create works derived from and store all submissions in any manner and or through any media in connection with the contest and the promotion of the contest without any compensation or liability to entrant.  You hereby irrevocably waive any moral rights you may have in and to any submissions resulting from the sponsors use of such submissions in the manner permitted herein and acknowledge and agree that the sponsors are not obligated to use your submission.

4. PRIZES: One (1) grand prize will be awarded.  The winner will be notified of prize by phone and email. WSUN will award the prize to the entry that features the most photos completed.  Grand prize is four (4) VIP tickets to 97X Next Big Thing, December 7, 2013 at Vinoy Park in Downtown St. Petersburg, FL ($500); four (4) passes to a meet & greet with an NBT artist (Sponsor choses band)($1); four (4) tires from Tires Plus (value not to exceed $500); four (4) NBT T-shirts ($100) (ARV = $1101.00)  The winner will be required to pick up their prizes Monday through Friday, excluding holidays, between 8:30 a.m. and 5:30 p.m. Winners are required to pick up their prize within 30 days of winning. WSUN allows one winner per household every 30 days excluding on air contests. 

5. ODDS: The odds of winning a prize depend on the number of people attempting to participate in the contest at any given time.

6. WINNER NOTIFICATION AND ACCEPTANCE: The Winner may waive his or her right to receive a prize. Prizes are non-assignable and non-transferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and WSUN-FM reserves the right to substitute prizes of equal or greater value.  The Winner is solely responsible for the reporting and payment of any taxes on prizes.  As a condition of receiving the contest prize, the Winner will be required to complete an affidavit of eligibility, and a liability and publicity release, which must be signed at the time the winner claims his/her prize at the WSUN-FM Business Office.  Failure of to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of WSUN-FM, and Cox Radio, Inc., result in winner's disqualification, the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Contest constitutes the Winner's consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from WSUN-FM, and Cox Radio, and on the Cox Radio Interactive Web sites, and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation.  The Winner's list may be obtained by sending a request with self-addressed, stamped envelope to Tires Plus/NBT Scavenger Hunt Winner List, 11300 Forth Street North, Suite #300, St. Petersburg, Florida, 33716.

7. PARTICIPATION:  Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules.  WSUN-FM, and Cox Radio, Inc. reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest.

8. LIMITATIONS OF LIABILITY:  By entering the Contest, contestant agrees that (1) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (3) under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all rights to claim punitive, incidental or consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

9. CONSTRUCTION:   All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestant and Cox Radio, Inc. in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Florida.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

10. GENERAL RELEASE: By entering the Contest, contestants release WSUN-FM, Cox Media Group, Tires Plus, any other promotional sponsors, and each of their respective parents, affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).

11. The “Tires Plus Next Big Thing Scavenger Hunt” contest is sponsored by WSUN-FM, Cox Media Group, Inc., 11300 Forth Street North, Suite #300, St. Petersburg, Florida, 33716 or, whose decisions regarding the selection of winners and all other aspects of Contest shall be final and binding in all respects.  WSUN-FM, and/or Cox Radio, Inc., will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials.
